Short Description:

It is the share of the premises affected in the building bears to the total number of shares into which the building is divided.

  • The undivided share can normally be found in the property schedule page of the instrument.
  • It must tally with that shown in the instrument and relevant computerised land register.
  • Check the Share of the Lot field in the relevant computerised land register for undivided share information.
  • Check the Property Remarks field in the relevant computerised land register for more undivided share information, if any.

FAQ:

Q1: If one of the Joint Tenants died, how to fill in the Undivided Share box for Death Certificate lodged for registration?
A: Either the full share or wordings such as "Deceased's estate, right, title and interest of and in (the undivided shares of the premises affected)" is acceptable.
Q2: If the property is held by A and B as Tenants-in-Common in 1/3 and 2/3 respectively and A died, what should be stated in the Undivided Share box?
A: The actual shares of and in the property to be affected (i.e. "1/3" which is the share held by A in (the undivided shares of the premises affected)) should be entered.
Q3: If A and B are Joint Tenants, how should I complete the Undivided Share box if A sold his interest in the property to B?
A: We accept the completion of the Undivided Share box with wordings such as 'the vendor's estate right, title and interest of and in (the undivided shares of the premises affected)' or '1/2 of (the undivided shares of and in the premises affected)'. The description should tally with that shown in the instrument.
Q5: For whole lot, what should be stated in the Undivided Share box?
A: Nothing is required to be stated in the Undivided Share box.
Q7: For Lease/Tenancy Agreement, is it necessary to complete the Undivided Share box?
A: If the premises affected is the whole unit, the completion of this box is optional. However, if the premises affected is only part/portion of a unit, it is not necessary to fill in this box.
Q10: In an Assignment, A (being a sole owner) assigns 1/2 share of the property to B, where should I specify the 1/2 share in the memorial?
A: Please specify 1/2 share in (the undivided shares of the premises affected) in the "Undivided Shares" box of the memorial.
