Post-enactment Review and Preparation for Title Registration : Position Report (September 2018)

In striving to formulate a practicable proposal that could have the general support of the key stakeholders for early implementation of the title registration system in Hong Kong, we have met with stakeholders including the Law Society of Hong Kong, the Heung Yee Kuk, the Consumer Council, the Hong Kong Association of Banks, the Estate Agents Authority and the Hong Kong Conveyancing and Property Law Association Limited during September 2017 to April 2018 to exchange views on the latest development of the Land Titles Ordinance (LTO).

Meetings were held with the LTO Review Committee and the LTO Steering Committee in October and November 2017 respectively for discussing and exchanging views on the proposed Two-Stage Conversion Mechanism and the proposal of implementing title registration on new land first (“new land first” proposal) as well as sharing with members the initial findings from the study of the latest developments regarding the title registration legislation and good practices adopted in several overseas jurisdictions with common law background. The overseas jurisdictions study has been completed and the draft report has been circulated to members of the LTO Review Committee for comments. We will continue to engage the key stakeholders in order to forge broad consensus on the “new land first” proposal for early implementation of the title registration system in Hong Kong.
