Post-enactment Review and Preparation for Title Registration : Position Report (1 March 2010)

The result of the public consultation in January to March 2009 indicated that the framework of “Daylight Conversion” mechanism provided in the Land Titles Ordinance (LTO) was preferred. It was widely agreed that to address the known cases with indeterminate title, modification should be made to the said framework. As to rectification, the result of the consultation indicated that two proposed exceptions to mandatory rectification rule were considered generally acceptable, and certain modifications need to be made to address concerns raised by the stakeholders.

The Administration made further reports to the Joint Subcommittee on Amendments to LTO set up by the Legislative Council.
The revised working draft of the amendment bill has been reviewed. The Land Registry will complete drafting instructions for the amendment bill after which further consultation will be conducted. The amendment bill will be put to the Legislative Council after the consultation.
